Please read the terms & conditions carefully before participating in “Pine labs. It contains the important information on the way the programme operates, your rights and remedies and the circumstances in which Pine labs’s liability to you may be limited We, Pine labs (Pine labs) are responsible for operating the programme. We have been appointed by the entity who has introduced you up to the programme and from whom you shall receive communications or rules concerning amongst other things, details of how to redeem reward points (“Contest Manager”)

The parties involved in a typical Programme are:

• Pine labs
• The “Contest Manager”, being the entity that signs up participants.
• The “Participants”, those participating in a Pine labs programme who are signed up by the contest manager, such as yourself
• And “Reward Providers” those providing the rewards (“the Reward”) that may be purchased / redeemed by eligible participants.

Please click on the button marked “I Accept” at the end of these Terms if you accept them. By participating in the Programme, you agree to be bound by the terms. Please note, if you do not agree to be bound by the terms, you will not be able to order any rewards from this site and may not participate in the programme and should notify the Contest Manager of this. Participation in the Programme and its benefits are offered at the discretion of Sobha Ltd. / Pine labs and Sobha Ltd. / Pine labs has the right to change the terms, in whole or in part, at any time as provided for in these terms.

ELIGIBILITY

• The Programme is accessible via the Pine labs web site located at https://sobhaprivilege.salutorise.com (“the web”).
• You must have Internet and an e-mail address and mobile connection to be eligible to receive the privileges and benefits of membership. Pine labs is not responsible for your inability to connect to the Internet.

By Participating in the Programme, you warrant that

• You are capable of entering into binding contracts
• You are atleast 18 years old

ACCRUAL OF Reward points

• As a Participant, you will be entitled to earn Reward Points through various schemes run by the Contest Manger. It is your responsibility to comply with the rules (Rules) specified by each Programme. These rules are designed by the Contest Manager and can be found under the rules section of each individual contest. Whether you are eligible to participate in any given programme and whether you have complied with the rules for fulfillment of any given programme, will be determined solely by the contest manger sponsoring such programme. Pine labs reserves the right to invalidate Reward Points posted to your account upon notice by the contest manager that you did not fulfill your obligations.
• Collecting Reward Points: Once you fulfill all applicable requirements for a Programme, your Reward Points will appear in your Reward Points account. Your account may be accessed by logging onto the website with your personal user name and password. It is your responsibility to regularly check your account to ensure that transfers have been properly updated.
• Tax implications of receiving rewards: You may be taxed on your accrual of Reward Points or your accrual of redemption of reward. You will be responsible for any and all taxes, custom, levies and other charges and liabilities arising out of your accrual or redemption of rewards. If Pine labs requires your cooperation or action to satisfy any tax authorities including VAT, GST, customs or excise body or other legislative or regulatory requirements, you will provide all reasonable assistance and carry out such acts (including the execution of documents required by or for Pine labs)
• Non-Transferability: No Reward Points may be assigned or transferred in any way by you to any third party. Accrued Reward Points are not a personal property item and will no be transferable upon death by contractual obligations or otherwise to any successor. Upon death of a member, his/ her membership account will be closed and all outstanding Reward Points will lapse.

ACCOUNT ACCESS

Upon initial enrolment for a programme, you should set your password that will allow you to access your Pine labs Account to verify transfers, check account balances and order rewards. You must be logged into the website and / OR mobile app using your e-mail address and / OR mobile handset and password, to access your account.

Pine labs is entitled to act on instructions received under your Pine labs account authorized by your password without further verification of the user identity. You are responsible for keeping your e-mail address, password, account numbers and other account information confidential. Pine labs is not responsible for any loss resulting from Reward Points or debits made to your account or other unauthorized actions taken by someone else who uses your password.

REDEMPTION OF POINTS

• Receiving Reward Points: The contest manager and the applicable programme rules set the actual time you receive your Reward Points.
• Viewing Reward Points: Upon completion of your targets, the Reward Points that you have earned will appear under the “my Reward Points” tab on the website. You may redeem these Reward Points for any reward that you can afford in the reward catalogue.
• Accruing Reward Points up over several programmes: You can save up your Reward Points over multiple programmes and use them to claim a more expensive item in the rewards catalogue, if permitted by the Contest Manager.
• Non- Redeemable Reward Points: Notwithstanding anything to the contrary, the provision of valid Reward Points is conditional upon receipt of payment by Pine labs from the Contest Manager.
• Ordering Rewards: Reward order must be initiated while logged in to the Pine labs web site / mobile app, using your user name and password. Pine labs will maintain reward catalogue on the website specifying the products and services which would be available for rewards against Reward Points accumulated in your account.
• Reservations: Issuance of redemption certificate for dining, travel or hotel accommodation does not constitute a reservation. The participants are responsible for making all reservations and notifying Pine labs of the reward he/ she is going to redeem.
• Order Acceptance: Once you have placed an order with the vendor and the same is automatically intimated to us, you will receive an e-mail from us acknowledging that your order has been successfully placed with the vendor. If a selected reward is not available, then the same will be notified to you. If this happens, the Reward Points will accordingly be credited back to your account.
• Delivery timescale: As per the rules of the program, Delivery of rewards will be done 20 days after redemption.
• Fluctuation in the Reward Points values for Gifts: Pine labs upholds the right, without previous communication, to change or remove offers from the catalogue to raise or lower the necessary amount of Reward Points due to price fluctuation from suppliers. The only actual version of catalogue is the one that can be found on the website of the Programme for which the participant has subscribed.
• Discontinued Gifts: Pine labs is not responsible for changes to, or discontinuance of, any Reward Provider’s Product, merchandise, or service, any reward providers withdrawal from any programme, or for any effect or devaluation of rewards caused by such change, discontinuance or withdrawal. Participants may not rely upon the continued availability of any reward. If a chosen reward is removed from the catalogue, where possible a gift of equal amount and quality will be offered. In that case participants can order something else with their Reward Points.
• Faulty Gifts upon arrival: Participants should contact the helpdesk by using the Contact us form on the website or email on sobhaprivilege@salutorise.com
• Cancellation: Once the order is placed for supply of the rewards as per your request, the same cannot be cancelled or withdrawn or changed and the Reward Points used for the same cannot be reversed. On receipt of the rewards request by Pine labs and on execution of the order, the Reward Points will automatically be deducted from your account.
• Risk and Title: The rewards will be at your risk from the time of delivery. Ownership of the rewards will pass to you when you redeem your Reward Points for the full value of the reward including delivery charges.
• Incorrect and Incomplete orders: Participants can contact the helpdesk by using the Contact us form on the website or email on sobhaprivilege@Salutorise.com
• Statutory Compliance: All request issued for rewards are subject to any statutory regulations, rules, restrictions, if any
• Warranties: Images mentioned in the communication or reward catalogue might vary from the actual product delivered. The rewards are provided by reward providers and not by Pine labs. Therefore if you believe that the reward is of unsatisfactory quality or are otherwise dissatisfied with it, the usual terms of warranty from the reward providers will apply. The delivery note of your order is also your proof of receipt. In case of warranty issues, please contact the Reward Provider directly under the terms of your warranty. The Reward Points would include cost of products sold/ services provided and any taxes such as VAT / GST that the reward provider will be liable to pay to the Government. Pine labs does not make any representation or warranty, express or implied with respect to the rewards and in particular in relation to the availability or performance of rewards.
• Terms & Conditions – when any participants seeks to use or obtain any services, benefits, facilities and arrangements as offered by the reward providers, the provision of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the provider of the said benefits, facilities and arrangements between the reward providers and you.

EXPIRATION OF REWARD POINTS:

Pine labs shall not be liable for any failure to redeem Reward Points for a reward within the time designated. Reward Points expire according to the rules listed here by the contest manager. No refunds or extension will be given for Reward Points that have expired. All Reward Points in Pine labs accounts with no earning or redemption activity for atleast 12 consecutive calendar months expire at the end of 12 month of inactivity.

TERMINATION OR CHANGES TO THE PROGRAMME

Contest Manager and Pine labs have the right to terminate or make changes to a programme at any time they choose. Redemption process will be communicated by the Contest Manager along with the notice of termination.. Notification of such termination and redemption process will be sent to the email address you provide to Pine labs during the registration process.

Pine labs may notify these terms at any time and from time to time by e-mail of any such modifications. Your continued participation in the Programme after delivery by Pine labs of an e-mail describing such modifications shall be deemed to be your acceptance of any such modifications.

ADDITIONAL RESTRICTIONS ON THE REDEMPTION OF REWARD POINTS

It is your responsibility to read and understand the information provided on these pages before participating in the programme. Further, it is your responsibility to review any e-mails sent to you by Pine labs describing modifications to the Terms and/ or the Programme. Pine labs will not be responsible for failing to so notify you were failure is caused by an error in an e-mail programme, an inaccurate e-mail address, a failure to check e-mail, a failure to ensure emails from Pine labs are not treated as junk mails or spam, or a failure to inform Pine labs of a change of e-mail address.

FRAUD, BREACH OF INTELLECUTAL PROPERTY RIGHTS AND TERMINATION OF MEMBERSHIP

Participation in the Programme is subject to these terms. In the event of fraud, misconduct, or suspected fraud or misconduct, misuse by you or anyone acting on your behalf or under your password, Pine labs reserves the right to suspend access to your account indefinitely pending investigation. Any member so disqualified shall not be entitled to redeem his Reward Points after such disqualification.

DISPUTES AND ERRORS

All questions or disputes regarding the Programme, including without limitation, questions or disputes regarding eligibility for the Programme, must be submitted in writing within 90 days of the qualifying transaction to Pine labs. Pine labs shall attempt in good faith to resolve any such disputes with you, following consultation with the Contest Manager.

WRITTEN COMMUNICATIONS

Applicable laws require that some of the information or communication we send to you should be in writing. However, when using our website, you accept that communication with us will be mainly electronic. This condition does not affect your statutory right.

EVENTS BEYOND OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (Force Majeure Event). Our performance under any contract is deemed suspended for the period that force majeure event continues, and we will have an extension of time for performance for the duration of that period.

MISCELLANEOUS

This Contract and these Terms and any disputes or claims arising from the Programme shall be governed by the laws of India and the competent courts in Mumbai shall have the exclusive jurisdiction to try any action or proceedings arising out of or in connection with this Agreement. If any provisions of these terms or any Contract is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible and other provisions contained herein will remain in full force and effect. Either parties failure to insist upon or enforce strict performance of any contract shall not be construed as a waiver of any provision or right. Nothing in the contract or these terms shall be construed as creating or constituting a partnership, joint venture, employment or agency relationship between Pine labs and you, any reward providers, the suppliers, nor shall any corporate provider have the ability to create any obligations on Pine labs’s behalf. These terms of the Contract constitutes the entire agreement between you and Pine labs with respect to its subject matter.

DISCLAIMER AND LIMITATION OF LIABILITY

Reward Points can be earned by you in a programme, provided that in no event will any other Company or person with which Pine labs is involved in the programme, including without limitation, those involved in co-branding, co-marketing, joint development, those in a reward provider relationship or a suppler relationship be liable to you for non performance of Pine labs’s obligations and you agree not to sue any such corporate participant for non performance by Pine labs. Pine labs will endeavor to see that the services, benefits, facilities and arrangements as expressed will be available to you. Pine labs will not be liable for any loss or damage, whether direct or indirect, arising from the provisions or non-provisions whether whole or part, of any such services, benefits, facilities or arrangements. Pine labs’s liability for losses you suffer as a result of us breaking this contract is strictly limited to the value of the reward you purchased, which we will credit to your account. Pine labs is not responsible for indirect losses which happen as a side effect of the main loss or damage. Pine labs is also not responsible for the following types of loss, loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management time however arising and whether caused by Tort (including negligence, breach of contract or otherwise. This does not prevent any other claims for direct loss that are not excluded by any of categories listed above. Where you use Reward Points to redeem any reward from a rewards provider through our website, the reward providers individual liability will be set out in its terms and conditions or warranty card.

When using our website, you accept that communications with us will be mainly electronic and for contractual purpose, you agree to this electronic means of communication. We will contact you by e-mail or provide you with information by posting notices on our website.

EVENTS BEYOND OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event)

GENERAL PROVISIONS

Sobha Ltd. / Pine labs may add, modify or remove any part of these Terms and Conditions of Use at any time as it may deem fit, with notice to Sobha Ltd. Any changes to these Terms and Conditions of Use or any terms posted on this site apply as soon as they are posted. By continuing to use this site after any changes are posted, you are indicating your acceptance of those changes.

Sobha Ltd./ Pine labs may add, change, discontinue, remove or suspend any other content posted on this site, including features and specifications of products or services described or depicted on the site, temporarily or permanently, at any time, without notice and without liability.

Sobha Ltd./ Pine labs reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Company's systems as well as its clients and users interests are and remain, well-protected. Towards this end, Pine labs may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by you.
